Terms of Service for Üben

Agreement

These Terms of Service ("Terms") govern your use of the Üben mobile application (the "App"), operated by Westmoreland Creative, LLC ("we," "our," or "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

The App

Üben is a German grammar practice app. It includes quizzes on noun articles (der, die, das) and plural endings, and, with Üben Pro, adjective endings and Präteritum verb forms, plus additional vocabulary levels. Features may change, be added, or be removed over time.

The App is an educational aid. We work to keep vocabulary and answers accurate, but we do not guarantee they are error-free or that using the App will produce any particular exam result or level of fluency.

Free Version and Üben Pro

The App is free to download and includes limited features, supported by advertising. Üben Pro is an optional one-time purchase. It is not a subscription and does not renew. At the time of writing, Pro includes:

The free version includes a limited number of adjective-endings questions and a limited number of user-added words. Which features are free or part of Pro may change over time, but a Pro purchase you have already made will remain unlocked for the features it included when you bought it.

Payments, Refunds, and Restoring

Purchases are processed by Apple's App Store or Google Play, not by us, and are subject to their terms. Refund requests are handled by Apple or Google under their refund policies; we cannot issue refunds directly. You can restore a previous purchase from the upgrade screen in the App using the same Apple or Google account. Purchases are managed through RevenueCat as described in our Privacy Policy.

Promo Codes

Promo codes may unlock Pro at our discretion. Codes may expire, be limited in number of uses, and have no cash value. We may deactivate a code that has been abused or shared in violation of its terms.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your own non-commercial learning, subject to these Terms and the usage rules of the Apple App Store or Google Play.

Your Content

Words you add yourself are stored on your device and are not sent to our servers. You are responsible for that content and for backing it up through your device's backup settings. Deleting the App removes it permanently.

Third-Party Services

The App uses third-party services, including Google AdMob (ads), RevenueCat (purchase management), Expo (app updates), and the Apple and Google app stores. Your use of those services is subject to their own terms and policies.

Intellectual Property

The App, its design, code, and original content are owned by Westmoreland Creative, LLC or its licensors and are protected by applicable intellectual property laws. These Terms do not transfer any ownership to you.

Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, Westmoreland Creative, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you, and nothing in these Terms limits rights you have under mandatory consumer protection law.

Termination

You may stop using the App at any time by deleting it. We may suspend or end access to the App, or to specific features, if you violate these Terms.

Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date above and, for significant changes, notify users in the App. Continuing to use the App after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Westmoreland Creative, LLC is organized, without regard to conflict of law rules, except where mandatory consumer protection law in your country of residence provides otherwise.
